During the holy month of Ramadan, ZAKAT, tax and customs carry out 10,000 inspection visits

The Zakat, Tax and Customs Authority carried out 10,000 inspection visits during the holy month of Ramadan on markets and shops in various regions and cities of the Kingdom.

The authority explained that the visits carried out by its supervisory and inspection teams in cooperation with the national program to combat commercial cover-up included a number of commercial sectors, most notably: retail, restaurants, and professional services offices, and indicated in this regard that these visits aim to enhance compliance with the provisions of tax regulations applicable in the Kingdom.

The authority added that the percentage of compliance with the tax regulations on which these visits were made amounted to more than 87% in most shops and markets, while limited violations were detected, represented in the failure to issue electronic tax invoices, and the lack of matching the QR code with the requirements of the authority, in addition to controlling other violations. According to the provisions of the system.

The Zakat, Tax and Customs Authority stressed that its inspection visits to markets, shops and service stores come within the context of its control efforts implemented by field inspection teams, with the aim of enhancing the degree of tax compliance among taxpayers from the business sector, and limiting commercial transactions in violation of the instructions and controls that fall within the authority’s jurisdiction.

The authority called on consumers to report any facility for which any tax violations are observed, through the official website (ZATCA.gov.sa), or through the authority’s application for smart phones, where the authority offers incentive rewards to those who report tax violations at a rate of 2.5% of The value of violations and fines, with a maximum of one million riyals or 1,000 riyals as a minimum.

ZATCA Carries Out More Than 1,300 Monitoring Visits and Deducts 88 Cases of Suspected Commercial Concealment As Part of the National Program's Efforts to Combat Commercial Concealment

The Zakat, Tax and Customs Authority's inspectors have carried out more than 1,300 visits in the last week to markets and shops in the Kingdom as part of the national program to combat commercial concealment, which involved more than 20 government entities.

The Authority has explained that the supervisory inspections took place in most regions of the Kingdom, including Riyadh, the Eastern Province, Makkah, Medina, Qassim, and Jazan, and included various shops, such as auto parts markets, food and beverages, health, and oil and gas. In this regard, the Authority has stated that the Riyadh region has witnessed the highest rate of inspections, with a total of 126 visits.

According to the Authority, the visits resulted in the detection of 88 cases of initial suspicion of commercial concealment. This comes with ZATCA's keenness to unify and unite efforts in coordination and cooperation with its government sector partners to combat commercial concealment in all its forms and types, as well as to increase tax compliance and minimize commercial transaction violations, with the necessity of continuing supervisory and guidance visits to markets and shops in all activities and fields.

The Authority has called on everyone to report any tax violations, through the Authority's website (zatca.gv.sa) or the Authority's App, which allows users to submit reports of tax violations.

Zakat, Tax and Customs Authority wins Excellence Award for Smart Government Corporate Services in Middle East.

Zakat, Tax and Customs Authority (ZATCA) received 27th Middle East Award for excellence in government and smart cities and smart government Institutional Services category, presented by the Middle East Institute for excellence in Dubai, United Arab Emirates, after competition government authorities from various countries of the Middle East countries participated.

Authority achieved the award for its operational and digital achievements during the outbreak of the coronavirus pandemic "COVID-19" in accordance with the best practices of smart institutional transformation, after harnessing all its capabilities and developing systems to ensure business continuity, which contributed the achievement of customer and taxpayer service on time and with high professionalism.

The authority has been keen to prepare the face the emergency conditions since the registration of first infection with the corona virus "covid-19" in the kingdom, through the preparation of human cadres, activating the business continuity strategy, and preparing the infrastructure for remote communication in all authority's headquarters, branches and ports on land, air and sea, and then determine the priority of services and critical users.

And technical solutions also contributed in smooth running of business with the same efficiency as it was performed in presence, which also enabled it to obtain ISO certification in the field of business continuity.

The authority has launched number of initiatives during pandemic to enable taxpayers to carry out their work remotely without affecting services or productivity, through the launch of 66 services on its official website that made it easier for them to complete services without need to review the branches and outlets of the authority.

It is worth mentioning that award will be given to government institutions in various countries of Middle East, and aims to encourage the creation of smart digital environment for governments, where it is subject to international and regional standards supporting the development of creativity and competitiveness. Zakat, Tax and Customs Authority invited establishments subject to VAT whose annual supplies of goods and services exceed 40 million riyals to submit their tax returns for the month of January, till February 28.

Authority urged establishments to quickly submit their tax returns via the website zatca.gov.sa in order to avoid the fine, in case of failure to submit the declaration within the specified period, at a minimum of 5% and a maximum of 25% of the tax value that the taxpayer was required to declare.

Zakat, Tax and Customs Authority makes amendments to the executive regulations of the real estate tax.

Zakat, Tax and Customs Authority has made amendments to the executive regulations of the real estate disposal tax, most notably the amendment to the degrees of relatives who are covered by the exemption from the payment of the real estate tax payment, and the amendment to the date of payment of the tax with regard to actions carried out according to sales projects, in addition to a number of other modifications.

Authority explained that these amendments will begin effect from Friday, 17 /07/ 1443H corresponding to February 18, 2022, and indicated that the most important things in the decision of amendment related status of relatives who are included in the exception from the payment of tax in cases of documented donation, up to the third status instead of the second status of relatives, provided that the ownership of the property is not transferred by the donee of the property for three years to a person who is not entitled to the exception from the payment of tax if the property is donated to him by the first donor directly.

Authority added that the amendments also included the addition of a new article concerned with the exemption from paying the tax on any property whose ownership is transferred based on a legal documented with the Ministry of Justice, without the requirement will be within the limit of one-fourth of the deceased’s estate as previously specified, and the expansion was also done. Excluding the gift of real estate free of charge for any atomic or civil endowment without stipulating that the gift be made only when the endowment is initially established.

The authority also clarified that it has made an amendment to the regulation stipulating that the tax is paid on sales that take place in accordance with the regulations approved by Cabinet Resolution No. (536) and dated 4/12/ 1437 AH, before the date of documenting the complete sale with the notary, approved without the necessity of paying tax before upon concluding the sale contract between the buyer and the owner of the property.

It is noteworthy that the real estate disposal tax is imposed at 5% on real estate whose ownership is transferred from a person or establishment to another person or establishment, such as sale, netting, transfer, gift and similar actions, with some disposals excluded in accordance with the provisions of the Real Estate Dispositions Regulations. Economist "Zakat, Tax and Customs" records more than half million real estate sales during 2021.

Last year, Zakat, Tax and Customs Authority registered 568,671 real estate sales within the real estate transactions tax service in various regions, cities and governorates of Kingdom of Saudi Arabia.

Only Riyadh city that recorded the highest sales of 144,468 , then Jeddah, which recorded 57,648, then the city of Buraidah 23,864 , Makkah 20,878 , while Dammam recorded 19,471 , Medina 18,061, Hail 14,600, Al-Ahsa 12,646 then Khobar 11,580 and Hafr Al-Batin 10,748 sales.

The real estate transactions tax service provided by the Zakat, Tax and Customs Authority is one of the electronic services that enable individuals and taxpayers from the business sector to register their properties in the real estate transactions tax before completing the real estate clearance process or documenting the contract, in addition to enabling them to know the extent to which their properties are subject to tax, with the issuance of a payment invoice for the amount of due tax.

It is noteworthy mentioning that the implementation of the real estate transactions tax came after issuance of order (A / 84) on October 2, 2020, which includes exempting all real estate supplies that are made by sale from Value Added Tax by 15%, and the imposition of real estate transactions tax by 5%, which is defined as " any legal act transferring.

Governor of Zakat, Tax and Customs sponsors the graduation ceremony for the third batch of "building competencies”.

​​Governor of Zakat, Tax and Customs Authority, Suhail Bin Mohammed Abanmi, on Tuesday, December 21, 2021, sponsored the graduation ceremony for third batch of "building competencies" program, which was presented by the authority in its third edition, which included 42 trainees male and female.

Zakat, Tax and Customs Authority provided the training program for all trainees with qualification and training in seven vocational training tracks: operations, legal and compliance, strategy and development, technical systems and digitization, analysis and risk, human capital, finance and administration.

First phase of "E- Invoice" comes into implementation.

First phase of Electronic Invoices (Electronic issuance and Save) came into implementation on Saturday, December 4, 2021, which includes all VAT –subject to taxpayers in the kingdom of Saudi Arabia – except non-resident taxpayers in the Kingdom-and any third parties that issue tax invoices on behalf of taxable suppliers.

Authority explained that the first phase of electronic invoices (Phase of issuing and saving electronically) consists in completely stopping the use of handwritten invoices or invoices written by computers through text editors or number analysis programs, as well as making sure that there is a technical solution for electronic invoices compatible with its pre-declared requirements, In addition to making sure to issue and save electronic invoices with all items, including QR code, serial number of the invoice for simplified tax invoices, the tax number of the buyer registered in VAT for tax invoices, in addition to making sure to include the invoice address according to the type of source.

Zakat, Tax and Customs noted the great awareness of large proportion of the taxpayers and their preparedness ahead of the scheduled date for the implementation of the first phase of the project, which confirms the role played by the authority to prepare private sector facilities and make aware them to the requirements of applying electronic invoices.

During the last phase, authority continued its awareness efforts in order to enhance awareness among all taxpayers, where it launched a detailed guidelines containing a detailed explanation of all tariffs related to electronic invoices, and clarifying the categories of E-Invoices regulations, in addition to the types of electronic invoices as well as the types of transactions.

"Zakat, Tax and Customs" announces the most prominent application for violations, electronic invoices and fines.

Zakat, tax and Customs Authority revealed the most prominent application for fines and violations of first phase of electronic invoices (Phase of issuance and save electronically) which will start from 4 December 2021, and explained that in case of violation for not issuing and saving invoices electronically fine will start from SAR 5,000, While the violation of not including QR code in the simplified tax invoice, violation of not writing the VAT registration number of the establishment that made the purchase in the tax invoices, and the violation of not reporting any malfunction that impede the issuance of electronic invoices it’s penalty starts from warning to establishment ,Authority also explained that the violation of deleting or modifying electronic invoices after issue penalty will start from SR 10,000, and explained that all fines will be applied according to type of violation and the number of times repeated, and explained more details about the violations and fines for the application of electronic during visit to website.

Authority stressed the importance the need to quickly prepare for electronic invoice regulation for their establishment with the requirements of the first phase of electronic invoice, and explained that the requirements to comply with the first phase consists in completely stopping the use of handwritten invoices or invoices written with computers through text editors or Added value of tax invoices, and also ensure that the invoice address is included according to type of source.

"Zakat, Tax and Customs" explained that the taxpayers subject to electronic invoice can consult the non-binding indicative list of providers of electronic invoices for technical solutions published on the authority's website at the following link, in order to choose the appropriate technical solution for the size of the facility and the type of sector, stressing that it is not understood from the list. The Zakat, Tax and Customs Authority had earlier launched the "Educational tour for Importing Vehicles", which includes the controls for importing vehicles in the Kingdom and its requirements for citizens and residents, and documents required to complete the vehicle import procedures, as well as vehicles whose importation is prohibited in the Kingdom of Saudi Arabia.

The two educational trips for air, land and sea importing vehicles are part of a series of educational trips that the authority provides through its website ZATCA.gov.sa for many Zakat, Tax and Customs regulations and regulations, where the duration of educational trips through the authority’s website exceeds one million training and educational minutes.

"Zakat, Tax and Customs" invites Taxpayers to submit their tax returns for the past month.

The Zakat, Tax and Customs Authority (ZATCA) has invited the business sectors to submit the tax return in the kingdom for the month of last October, maximum time till 10 November.

The authority urged its officials to submit their tax returns quickly through its website (ZATCA.gov.sa), in order to avoid the penalty for default in the specified period, 1% of the unpaid tax for every thirty days in case of delay from the due date.

Tax deduction is one of the tax regulations implemented in KSA that is deducted from the total income of non-resident in the kingdom for the services provided by KSA, in accordance with specified Article 63 of the Income Tax Regulations.

"Zakat, Tax and Customs" applies the new VAT entitlement mechanism for establishments contracted with government agencies starting from Today Monday.

The Zakat, Tax and Customs Authority will begin on Monday, November 1st, 2021, the implementation of new mechanism for VAT accrual for establishments contracted with government agencies, following the recent decision of the board of Directors of the authority to approve the amendment of the provisions of Article (20) of the executive regulation of VAT, which specifies the date of supply.

This amendment to the regulations includes changing the date of supply and the accrual of Value Added Tax on all supplies of goods or services made by establishments contracted with government agencies in accordance with contracts concluded agencies with the government competition and procurement system, so that the date of entitlement to the tax is the date of issuance of the payment order for the claim for the supplies subject to tax in accordance with the procedures of the competition system or date of receipt of the supply return, in order to ensure that the establishments receives the tax for the supply prior to its declaration and payment to the authority in its periodic declarations.

The authority has held several awareness workshops on this amendment since the first day of the issuance of the amendment resolution, in cooperation with government agencies, business sector and Federation of Saudi Chambers, in order to clarify all the details regarding the amendment and its desired objectives.

The Zakat, Tax and Customs Authority recently launched the Simplified Guide to modify the tax processing of supplies made by establishments for the benefit of government agencies according to competition and government procurement system, which includes definition of the decision with a simplified explanation of the new mechanism, in addition to the tax return.

"Zakat, Tax and Customs" 40 days remaining on the application of the first phase of E invoice (invoice).

Zakat, Tax and Customs Authority (ZATCA) has called on its officials subject to the e-invoice regulation for necessary preparation quickly with the requirements of the first phase, which remains 40 days, which will come into implementation on 4 December 2021.

ZATCA explained that the requirements to comply with the first phase of E invoice are to completely stop using handwritten invoices or computer-written invoices via text editors or number analysis software, as well as to ensure that there is a technical solution for E invoice that is compatible with its requirements.

The requirements also include ensuring the issuance and preservation of E invoices with all items, including QR code for simplified tax invoices, the buyer's tax number registered in VAT for tax invoices, in addition to ensuring that the invoice address is included according to the type of issuer.

"Zakat, Tax and Customs" stressed that the taxpayers subject to E invoice can consult the non-binding indicative list of providers of E invoice solutions, which was previously published on the authority's website via the following link.

"Zakat, Tax and Customs" invites taxpayers from the business sector to submit VAT returns for the month of September and the third quarter.

The Zakat, Tax and Customs Authority (Zakat) has invited those from the business sector subject to VAT to submit their tax returns for last September and the third quarter of 2021, till 31st of October.

"Zakat, Tax and Customs" urged business sectors to submit their tax returns quickly through the website (ZATCA.gov.sa), to avoid fine and declaration within the specified period, at a minimum of 5% and a maximum of 25% of the tax value that the taxpayer had to declare.

“Zakat, Tax and Customs" seize more than 900 tax violations in a week.

The inspection teams of the Zakat, Tax and Customs Authority have seized more than 900 violations of the provisions of the tax regulations in the kingdom of Saudi Arabia, during which they carried out more than 8,500 inspection visits during the past week, on markets and shops in various regions and cities of the kingdom.

The seized irregularities ranged from the non-issuance of tax invoices, the non-collection of VAT from the consumer, as well as the absence of a tax number on the invoice, as well as the absence of tax seals on tobacco products.

The authority invited consumers to report any establishment for which any tax violations are detected through the official website .ZATCA.gov.sa), or through the VAT application on smartphones, where the authority offers incentive bonuses for tax whistleblowers at a rate of 2.5% of the value of fines up to a maximum of one million riyals or a minimum of 1000 riyals.
